Outrage is right!! Please ACT!!

Demarie DeReu

Sixteen-year-old Demarie DeReu is an honor roll student, a member of the Columbia Falls (Montana) High School Student Council and a varsity cheerleader. Although she has no intent to break any rules or laws, or harm anyone, Demarie is at risk of having her college education derailed and maybe even being identified forever as a domestic terrorist.

Why? Demarie went hunting over Thanksgiving with family and friends. She forgot that her unloaded hunting rifle was cased and locked in the trunk of her car. When she arrived at school, she parked in the school parking lot because to park anywhere else is an expulsion offense at CFHS. Upon hearing that the "contraband dog" was to be working the school parking lot, Demarie remembered her unloaded hunting rifle secured in the trunk of her car AND she voluntarily informed school officials.

Next monday, December 13, at 6 PM, Demarie will face her expulsion hearing before the local school board. She will possibly have her life derailed because a bunch of school idiots insist that she must be subject to an irrational, "zero tolerance" policy about guns in schools that does not countenance lack of bad intent. The theory that people with malice will be intimidated into good conduct if people without malice are punished in lieu of them is idiocy at its finest.

At the upcoming hearing, education officials will tell school board members that they have no choice - that state law and good gamesmanship require the school board to levy harsh and record-destroying punishment against Demarie. They will be wrong!

The controlling Montana law about this is 20-5-202, M.C.A., which says about expulsion for bringing guns "to school," "... the trustees may authorize the school administration to modify the requirement for expulsion of a student on a case-by-case basis." Further, "to school" is not defined in 20-5-2-202, but is at 45-8-361, M.C.A. as "... in a school building." Demarie's hunting rifle was cased and locked in the trunk of her car in the parking lot, but not "in a school building."

What can you do about this outrage?

Forward this message to every gun owner you know, in Flathead County, in Montana, or elsewhere.

Send messages to school officials and school board members. Use your own words and be polite. Remember, they think they wear white hats, even if you don't think so. It IS okay to say you feel very strongly about this, but no profanity and no name-calling, please.

1) Demarie DeReu should be given no more than a verbal warning that she should not in the future pack her hunting rifle to school (I think she's learned that by now);

2) Demarie DeReu should be given an award for being honest and volunteering to school officials about the unloaded and cased hunting rifle locked in the trunk of her car;

3) Demarie DeReu should be held out as an example to other students for her participation in essential wildlife management in Montana; and

4) That when the Legislature considers education funding in the upcoming legislative session, legislators will consider the outcome of this case as an example of how schools are using taxpayer resources in Montana.

Show up. Finally, if you are in Flathead County or within driving distance, gather all of your friends and show up at the CFHS school board hearing next Monday, 12/13/2010. Better yet, show up at the CFHS at 5PM with picket signs that say "Free Demarie DeReu." There ought to be 1,000 of you there!! Organize!! Show up!!

So this Montana Justice Of the Peace did NOT even read this complaint that violated my right and came from someone who the Hamilton Courts had record of that I claimed threaten to Kill Me and She gave him a Protective Order against me without reading the complaint or doing anything to prove that I was NOT in an Danger and I Gave her the information to Easily go Get the Proof.

The Complaint on me to Judge Robin Clute in Hamilton Montana had no basis of it being fact what so ever, and yet Judge Robin Clute immediately faxed that un-notarized,unRead Complaint the Complainant's Friend, Officer Maury McKinney in Eureka, Montana and had me served. All based on a Complaint that was not Notarized, not even Read by Justice of the Peace RobinClute and had no basis in fact what so ever.

Judge Robin Clute in Hamilton Montana gave a year long protective order against me, and said in a Year she would make it permanent... she did not do that at the end of Sept. 2010 for some reason, not sure why she backed off and am waiting forJudge Robin Clute in Hamilton Montana to set me up again..

From that Day that I was served this Illegal Protective Order the Complainant has harassed me, defamed me, gathered other haters against me from across the United States... read everything I wrote daily on Paid time at the University of Montana and emailed anyone I wrote about that he could to tortuously interfere with my making money, my media company and my way of life - all protected by and Illegal Protective Order issued unfairly, unjustly and illegally against me byJudge Robin Clute in Hamilton Montana

If a Complaint is NOT sworn under penalty and perjury, well the Judge who issued the Protective Order based on a Complaint that violated the Montana Law - well then that judge is liable under penalty and perjury.

Ron Kosena State of Montana took was "Assigned" to investigative my Death Threat and the Connection an Email from the State Of Montana IP Address Mitchell Building Helena, and My Famed "Jimmy Boston" emails which were directly connected to my Death Threat Emails.

A Good Tech Savvy Investigator would easily prove where the "Jimmy Boston" email came from, the User information was all there. So why did Ron Kosena - Paid by your State of Montana Tax Dollars Flat OUT Fail to Investigative this VERY Serious Montana Hate Crime?

I Told Ron Kosena that I was in fear for my Life, I told Ron Kosena that the Jimmy Boston email was connected to my Stalker, Connected to my Death threat and that I believed it came from a Local Law Enforcement Officer. Ron Kosena told me he took this very serious, in that first call, which for my records I have a Recording Of.

Ron Kosena did not take this Death Threat serious and in fact disappeared, when Ron Kosena - State of Montana could have easily figured all this out. It is VERY Simple to Prove.

This Person was on my blogs at the same time as my University of Montana Stalker, they both typed in threatening keywords.. they used similar words.. they emailed each other my posts.. and WELL the Lincoln County Sheriff's Office and the Eureka JP Office are on the Server IP Mitchell Building 6 - State of Montana.. no worries... see after Ron Kosena Disappeared, Conviently so did that Stat... it is Now just State of Montana or some other server.. or they had a Talk with the guy. Ms. Langstaff will make an appointment with the public, then ban them from the library, so to not uphold the meeting scheduled.

Montana Law is very specific: a library director has no power to take library access from a patron. Only in Hamilton, Montana does the Police and the Library director work together to commit crime.

according to Justice Brennan former US Supreme Court Justice: "Even the slightest redeeming social importance--unorthodox ideas, controversial ideas hateful to the prevailing climate of opinion..." was protected by the first amendment. BUT NOT AT THE BITTERROOT PUBLIC LIBRARY!

The other librarians in tow, looking extra special "going after" someone who was minding their own business, speaking or bothering no one, did not get asked to leave the library, and the director did a "positive identification" on the offender, executed a call into the Select Committee on Election: The Hamilton Police Department.

This is not a joke. We ask that those who wish to test their luck with fate, like the running of the bulls in Italy, ask for the President's letter from the front desk. If you can survive for 8 seconds, you can have a membership at this wonderful 1 room library. Embezzlement is amongst the fun we have in Hamilton, Montana at the "free" library.

Free to tax the county excessively, use volunteer labor, take estate gifts, and get free accounting, and lease (sorry, $1/yr) from the City of Hamilton. Maybe they should have been friendlier to a candidate for the office of Mayor. Once again, please stand by for our feature film documentary due out in September. BPL is toast. The Bitterroot Public Library violates right to assemble, speak, to read, and enjoy a state sponsored right of a "free" library. The "5-year plan" includes:
expanding the 'program area' (this is the "romper room" area) for the children

The Bitterroot Public Library seems to not be interested in books, or adult learning.

The State of Montana has a library governing document which states that all policies are available to the public as per Administrative Law. Ms. Langstaff informs the Hamilton Police and brings banned books to them.

As per the ALA guidelines, no librarian can censure material from a viewer, or potential reader if not profane nor obscene. The "right" to read, the "right" to view (see http://www.ala.org/ ) has been violated by the Bitterroot Public Library Director.

If the first amendment is not important to our library director, we have found a new area to request our rights. Freedom of speech is being taken by our own public officials in a manner that is consistent with "organized" crime; prearranged understanding and involvement with local law enforcement.

The Bitterroot Public Library would rather keep their '08-09 budgeted $611,000 in the bank of taxpayer money (budget year '09-'10 has $513,000--so where did $100,000 go?).

The Bitterroot Public Library would rather not uphold their own policies, not provide any policies to the public, and be exclusive about what materials come into the library. No public service standards apply, nor any American Library Association guidelines and procedures. The public in the Bitterroot Valley deserve better, it will be so soon. Please run for County office----see the ELECTIONS PAGE for details.

These are our public officials, not answering to the public; making their policies public nor accessable, and not using our tax dollars appropiately. This is why we need to change our Valley by electing public officials who will work for us, instead of a "group", or themselves.

Sir,

I write to you with respect, admiration and hope. In this time of our nation’s strife, I do not ask for monetary relief or a bailout. Sir, I have lost everything that I hold precious in life, I live in Ravalli County, Montana. There are no civil rights here, there is no justice here, and there is no one to appeal to. I want my human rights, and my freedom back.

I am 67 years old, I was raised in the Navy, and served in the USCG for four years, I served 25 years in the Seattle Fire Department where I retired on 9/11/91. I have served my country my entire life and I still abide by the oath’s that I swore to defend my Flag, the President, and to serve the American People, as did my Father.

Sir, I moved to Ravalli County, Montana in April of 2002. After 911 I wanted to try and start over as I felt that my time of usefulness had passed. Fate works in strange ways and my duty as an American was to be tested like never before. I found myself in the midst of ignorance, racism, hate crimes, nepotism, and corruption, where the weapon of choice for criminals is the American Flag.

I fight for America Sir, and now the rumble has reached the White House. The horses hitched to your wagon have brought you into it. The truth shall set us free.

I present to you the “unbelievable” daily life of American citizens in the Ravalli Territory, the Holy Grail of injustice in America:

Montana is the third largest state in the lower 48, yet has a population of less than one million residents. It has three electoral votes with one Congressman and two Senators. There are 56 counties distributing the power of the United States Constitution.

The present Governor of Montana states that “Montana is for Montanans”, and openly mocks the government of the United States. I am an American, not a Montanan.

Ravalli County starts at the Idaho border to the South, runs the length of the Bitterroot river, with the Bitterroot Mountains to the West, and the Sapphires to the East. There is one road, Highway 93, in or out. No news goes out and very little comes in as we have no Newspaper, and one radio station. It is isolated and remote.

The County Government is the cow that feeds it. It offers jobs to those who are willing to buy in. All others are treated as “illegal aliens”.

The County Attorney is an all powerful entity, above the laws of the United States, openly protected by the State and our National Representatives. Ravalli is a micro climate set up to set the standard for the rest of the state. It can be compared to a “black hole”. Seventy percent of Ravalli County is Federal land. This is a Third World Country within the State of Montana. No person or entity can, or will claim jurisdiction here. Is this the template for the new America?

Very few people in this state go unaffected or untouched by these events of violation.

The last Census said there were approx 37,000 residents, of which 29,000 are of voting age. Amazingly all of them are “registered voters”. The Secretary of State claims to have very little control over voting laws in the county. They are defined by the County Attorney as to who shall , or shall not vote, and what they may, or may not petition.

The County Sheriff is an elected official and is the head Law Enforcement Officer in the County. There is no criteria to be the Sheriff.

The current Sheriff received a unanimous vote of “no confidence”, from his department and yet was re-elected. Any group will only be as good as it’s leadership.

There are five elected County Commissioners, all paid.

They have no say over the County Atty (CA) , or Sheriff. The CA regularly overrules any legislation they try to pass regarding zoning or permitting. They are pretty much powerless, with main emphasis on who shall sit on county boards.

The City of Hamilton is the County seat. There are less than 4,000 people living within the city. They have 6 city council seats, an all powerful Mayor, a city Judge, and a Justice of the peace, all of whom are elected. There is no City Treasurer although the citizens passed a petition to have a Treasurer.

The words “and to the Republic”, mouthed by these officials during the “Pledge of Allegiance”, refers to the local newspaper.

The City Attorney, works under contract, also acting as prosecutor. This attorney worked for almost 6 years without a contract, and never swore an oath of office at any time.

This is a blatant violation of State Law.

His comment about that is, “ it is ridiculous to think that I should have to swear an oath”.

The State bar, and the District Court Judge, said it was ok to violate state law and swear the oath 6 years later. The Court system prides itself on very tough justice with a 90 percent conviction rate of violators of the law. All judges and city attorneys are former prosecutors for the County.

Hamilton Police Department has a force of fifteen officers.

A normal town has one officer per thousand population. They have the run of the County as their jurisdiction. They have been out of control for a very long time. The “tail wags the dog” here. They are almost all of “local flavor”.

The Police Chief acts with impunity to any authority including, county, state and federal.

The City of Hamilton is not incorporated.

City limits were never established; no census of the population was ever taken, and there was no election held by those citizens to establish the “City of Hamilton”. Therefore, what is the legal standard and criteria by which this illegal group administers, executes and prosecutes the laws of the State and Constitution of the United States.

How can they issue permits and tax the people?

How can they be allowed to hold elections for a nonexistent entity?

The County Attorney claims he has no authority in issues within the city of Hamilton. People within Hamilton may not vote on county issues by order of the County Atty. The Sec of State has no record of Hamilton, Montana therefore no controls regarding voting.

The Fire Department claimed by Hamilton is an all volunteer group of 20 Fire Fighters, none of which are paid. Their services are minimal, and there is no standard or criteria as to qualification or training. They are an entity separate from the city.

They are the First Responders to the NIH Rocky Mountain Lab a level four biolab. There is no way these men should be expected to cover this facility. RML gives a grant to the HVFD to buy a 100 foot Aerial Platform, surely the most useless piece of equipment they could have. There is no one who knows how to drive it, and no where to park it. There are no buildings over 3 stories in the county or city.

The Fire Chief quotes to me, “we need the Aerial Ladder so there are no ground ladders up when the walls collapse”. There are no paid fire fighters anywhere in the county that I know of.

NIH has put science before the safety of American Citizens.

This county would be an excellent place to move Guantanmo. There is no escape, no rights and no one to complain to.

However, the rest of the world might regard it as “cruel and unusual punishment”.

In 2001 three women are killed in a Florence, MT beauty salon in broad daylight, The case remains unsolved.

In 2002 a Hamilton officer shoots and kills a man involving a domestic dispute. Six months later a coroners (a former Hamilton City Police Officer, and current Sheriff) inquest finds it justifiable.

In 2002,the State loses it’s viable Power Company which was publicly owned. Jobs, pensions and a public utility all are shuffled and sold. This was considered business as usual here with no investigation by the State or federal government.

In October of 2005, a man has barricaded himself in a gas station convenience store at the edge of town after briefly holding the employees hostage. His white pickup truck, a second male passenger, and a large white bag on the ground are left in a driveway around a corner from where the man has fled.

The owner of the home asks the remaining man if he is ok and the man says, “yes, but my buddy is really messed up“.

He walks around the corner and watches with the Police.

Quite a while later the home owner watches a third man pick up the bag on the ground, toss it into the truck and drive off.

Law enforcement from all over Western Montana have surrounded the station, blocked off the highway, and wait for over 9 hours before attempting to enter. The Hamilton Police chief is in charge of the scene.

They find the man has killed himself in the bathroom. He has a briefcase containing $4000 dollars he had robbed up in Flathead County. The News Media had covered the episode from the earliest minutes and report a sad but successful end to the story. Law enforcement are commended for their good work.

There is no mention of the second man or the money. Two days later, the Ravalli County Sheriff’s dept shows up at a residence at the end of a road about 10 miles out of town and wants to know where the missing $200,000.00 from the robbery is?

The residents are dumbfounded to learn that the truck used in the robbery has turned up abandoned on their property. No mention of this has ever been made public that I know of. The witness where the truck originally stopped is advised by a state official to keep her mouth shut.

Within a six month period in 2005, five inmates hang themselves in the Ravalli County Jail. A coroner’s inquest finds everything ok.

What could cause such desperation of these men, to take their own lives. Who were they?

What had they done? There was never a trial or question of who and why.

Death at the hands of law enforcement
is taken for granted as “normal” in Montana.

Several jail employee witnesses are terminated.

There are survivors who lost their loved ones, fathers, sons, and friends. There are those that know the truth and must live with it. There are those that must cover up the truth further enlarging the ripple and the quicksand trap it feeds.

The Police chief retires from the City dept to take a job with the NIH Rocky Mountain lab. The lab turns down very qualified people for administrative and security positions keying for what they describe as “local flavor”.

They hire the City Administrator, along with the Police Chief. The closest professional help for any emergency is in Missoula, at the least, 90 minutes away. The same campus in Bethesda, MD has a 30 man fire department covering their lab.

The 20 Hamilton Volunteers are neither trained or qualified to address any part of an emergency within this facility and should not be asked to do so. Certified letters sent to Bethesda regarding this situation have disappeared. NIH security is often seen patrolling the streets of the city.

The District Court Judge for Ravalli County is pulled over by Hamilton Police and charged with DUI.

He is ticketed and booked. His story is spread all over the “Ravalli Republic”. He is pulled over again in Missoula and charged with the same thing. He admits to a problem, says he will go through the rehabilitation and is allowed to keep his position. The Officer doing the initial arrest will be referred to as “not so super“, Notso.

The officer often testifies to the Judge, along with the Hamilton City atty who doesn’t think the Oath of office means anything. The Montana Disciplinary Committee, aka Bar Assn, says “no problem”. This man had once been a respected and trusted Judge, now his opening line must be “How may I please the state”?

The local daily newspaper, the Ravalli Republic is owned by Lee Enterprises. It is totally controlled by the County attorney here, and all of it‘s other publications will only print the party line. Falsehoods causing much grief to innocent people are regularly published, yet retractions and other viewpoints are staunchly avoided.

Any innuendo that something is foul in Montana is rewarded with a “fuzzy bunny” story as the County Attorney, and other State Officials reminisce of happy times in their rise to success . Made up “awards” and plaques are given with accolades to Police Officers, and their leaders for their “humanitarian” work.

There are few, if any newspapers in Montana which are not owned by Lee. I would liken it to Pravda.

A retired Army Veteran is parked in front of his Physical Therapist office in the middle of downtown Hamilton in the afternoon.

He is waiting for his appointment time. He looks up to see a gun pointed at him in the drivers side window. There are three more Hamilton Police officers in position with guns pointed , demanding he get out of the car.

He gets out and is braced and searched. He finds out that he is suspected of being a terrorist shooter because he is wearing a leather vest. He is told to watch his step.

In 1949, I recall having a butterscotch sundae with Mr Watling, at NAS Niagara where my father was stationed. He was a Navy jet pilot and he was leaving for Korea. I don’t remember what we talked about except that he had noticed my “cub scout hat”, and that he seemed pleased to be with me.

I can never forget the respect, that my father showed him at our introduction. The newsreels at the movies were never the same when I found out that he wasn’t coming back. I was probably his last memory of America. I learned early the responsibility of my heritage.

A young HPD Officer is appointed by the unincorporated Hamilton City Council to be the new Police Chief in spite of pressure by community leaders to get an outside professional for the position. The force now numbers 15.

A normal city will have one officer per 1,000. Hamilton has less than 4,000 residents. On any given night the town lights up like the Aurora Borealis with blue lights flying everywhere. It appears that the tickets are the towns only income. One rookie officer sets the record with over 100 unsupervised arrests and is applauded for his wonderful work.

At the end of his year probation, he swears the ” oath of office”. He regularly holds “show and tell” with other citizens showing the actual videos of his arrests with commentary about the victims. These officers carry real guns with real ammunition, they are brandished regularly.

Sir, with your connections, could you get Supercop, a few days of duty on the streets of Chicago? Better yet, let’s just swap departments for about a week.

A retired decorated LA Police Officer, who was disabled after being run down by a murder suspect lives here. He is a former United States Marine who has served abroad, and willing community volunteer. He joins up with members of the USMC Band who are performing at the County Fair. He attempts to give some of them a ride, when after pulling out of his parking place, he is pulled over by “Supercop”.

He is accused of cutting in front of the police car and DUI. Supercop gives the “Mic on, Mic off”, routine to the flustered veteran, and writes him a serious DUI ticket. The Vet is devastated and seeks counsel outside of Ravalli County.

The attorney urges him to plead “per se” and take the consequences, as he says the “police there, will lie”. The Vet does as urged and has the book thrown at him by the Hamilton judge who is a former Marine adjutant proud of the harsh sentencing handed out in Hamilton.

He is devastated and embarrassed. He goes to his health club, and there Supercop and others openly and publicly mock him.

The man resigns from the health club and has to see a shrink to get his health and composure back. The Vetcop is pulled over months later for DWIH (Driving While In Hamilton), and the officer immediately goes to the mans license tabs where he finds that the “numbers don’t match”; amazing police work.

This place is a vipers nest where honest, good people are not welcome and openly discriminated against. Like all of us, he is wounded and will never be the same. He has lost his faith in America.

Is this the greeting returning vets shall receive? Is this what we all served for? Is this the legacy for our children?

A Native American man is shot and killed in Darby by the town Marshal. The Marshal has been notorious for ticketing a very famous late night talk show host and for anally tight law in his town, which is referred to as “camera land”.

Fines are payable then and there.

He responds alone to a domestic dispute and gives a pat story the night of the shooting . It was portrayed that he had responded to the place and was immediately jumped by the man, whom he knew well. While fighting to keep his gun away from the man, he shot him twice.

This was all over the news that night and the next day. When relatives showed up, they found the girlfriend was under arrest in the hospital, and there was reportedly another witness.

The Marshal was wired for tape.

Six months later, during a Coroner’s inquest, a new version of the story unfolds where the witnesses could not remember anything , and parts of the tape are blank. The last words you hear are the Marshal stating that he was going to shoot the man, and then he does. The death is found justifiable.

I ski in the winter and often ride the chair with students up for the day. One young man is always dressed in dark blue and never without a ski mask on. I have talked to him several times and learn he is a home school student from Darby.

One day he tells me that it is his birthday and that he just got an assault rifle with a stainless steel barrel that wont wear out. He wants a pair of twin tip skis like mine so he can ski backwards and shoot.

“I am very seldom at a loss for words”.

While serving in the USCG, I spent a year of isolated duty on an island in the Aleutians. After a while you lose the perspective that there really is anything outside of where you are. People who have been in combat or taken long sea voyages will give you the same comparison.

Hostages tend to accept and sympathize with their captors and go along with it as a survival instinct. You do whatever it takes to fit in. I believe it is called “Stockholm Syndrome”. It is a very necessary trait one should have to live in Montana. ""

Thank you for your interest in the Fully Informed Jury Association (FIJA). This information will give you an overview of our purpose and projects. I hope that when you have finished exploring this site, you will decide to become a supporter.

As I am sure you know, the highest and best function of the jury is not, as many think, to dispense punishment to fellow citizens guilty of breaking the law, but rather to protect fellow citizens from tyrannical prosecutions and bad laws imposed by a power-hungry government.

Juries protect society from dangerous individuals and also protect individuals from dangerous government. Jurors have a duty and responsibility to render a just verdict.

They must take into account the facts of the case, mitigating circumstances, the merits of the law, and the fairness of its application in each case.

The recognition of the authority and right of jurors to weigh the merits of the law and to render a verdict based on conscience, dates from before the writing of our Constitution, in cases such as those of William Penn and Peter Zenger.

Should this right ever be suppressed, the people will retain the right to resist, having an unalienable right to veto or nullify bad and oppressive laws, and in fact then would be morally compelled to do so.

Jurors, as the representatives of the people, hold no personal agenda during any trial and most certainly not the government’s agenda.

Let us not forget that the prosecutors, judges, arresting officers and the forensic investigators in mostcases are all a part of and receive their paychecks from government, with personal power bases to build and personal careers to protect through the productivity of successful prosecutions resulting in convictions. Jurors have no such stake in the outcome, and are, in fact, the only truly objective individuals in the courtroom.

The role of our jurors is to protect private citizens from dangerous government laws and actions. Many existing laws erode and deny the rights of the people. Jurors protect against tyranny by refusing to convict harmless people. Our country’s founders planned and expected that we, the people, would exercise this power and authority to judge the law as well as the facts every time we serve as jurors. Juries are the last peaceful defense of our civil liberties.

FIJA works to restore and protect the role of the juror, and the institution of Trial by Jury.

We sponsor educational seminars for legal professionals, publish commentary, develop and present Amicus briefs when the institution of the jury is at issue, provide interviews to the media, speak at functions and in classrooms, and of course distribute educational literature. Our newsletter The American Juror is published quarterly. We articulate that the authority of the jury is the right that protects all other rights.

I became aware of the liberty movement in the spring of 2007 but did not dive in head first until the end of that year. The past year and a half has been a whirlwind of rallys, conventions, education, successes, lessons learned and great community.

It was indeed the good Dr. (Ron Paul) who helped me realize that Republicans are not necessarily “bad” and it was his supporters who showed me the beauty and necessity of liberty. Food Sovereignty

"'" Food Sovereignty is the idea that all people should have access to a dependable and nutritious supply of nourishment close to where they live.

This is the foundation on which a healthy and productive society is formed. Today we suffer from a corporate controlled food industry with ties to the military-industrial complex. Small family farms cannot compete with the government-subsidized mega-corporations who have industrialized the very things which give us life. The struggle for Food Sovereignty is the struggle to return to community self-reliance and cooperation.

Real I.D.
We believe that the Real I.D. act of 2005 violates the sovereignty of the states by imposing mandatory national identification. We believe that a National I.D. violates the Fourth Amendment by infringing on Americans’ right to privacy, and Americans’ property rights.

We believe State Legislatures should reject any connection with the Real I.D. Act. State Legislatures should reject this invasion of state sovereignty by the Department of Homeland Security, an unelected executive department. We believe individual states have adequate power to identify and credential their own citizens.

Smart Port/NAFTA Superhighway
The citizens of Kansas City and Western Missouri have not been provided information about the KC Smartport plans and the North American Super Corridor Coalition (NASCO: also known as NAFTA Superhighway), nor have our representatives been a part of the process.

We believe that the taking of land for the advantage of US and foreign corporations is a direct attack on our liberties and sovereignty. We believe that this large highway, rail and pipeline system will not only be a scar on our land in appearance and pollution, but will increase crime, drug trafficking, and illegal immigration to our city.

All land, currently leased to Mexico and considered Mexican soil in Missouri, should immediately be returned to the people. All plans for the NASCO Superhighway, and the plans to make Kansas City the entrance into the United States for freight, need to be produced for the public and be open to discussion and debate.

U.S. War Policy
Only Congress has the Constitutional legal power to declare war. We agree with our first President, George Washington, that our foreign policy should seek peaceful commerce with all nations and entangling alliances with none.

As such, we advocate bringing home the men and women serving in the Afghan and Iraqi conflicts as rapidly as safely possible.

Intrusive Legislation
(Patriot Acts, Military Commissions Act, Homegrown Terrorism Act, New Born Children Save Lives Act, Real ID Act, NAIS, etc…)

ANY legislation that violates the Constitution and the Bill of Rights is an assault against the civil liberties of Americans and cannot be tolerated in a nation that purports to uphold the Natural Rights of its citizens. For example, the Patriot Act 1 & 2 violate the First Amendment by allowing government agencies to demand that Librarians turn over the booklists and internet records of their patrons without a warrant, and then making it illegal for those library personnel to inform their patrons of the illegal searches.

These acts violate the Fourth Amendment by allowing government agencies to conduct secret illegal searches of homes and property without probable cause and collecting computer files and reading lists, video and magazine collections.

Some of these acts also violate the Constitution by allowing indefinite imprisonment of persons without a lawyer. The accused also may not have the right to face their accuser.

This denial of individuals’ access to courts leaves them in a condition where all due process rights are suspended.

Presidential Executive Orders
We oppose the power of the President to issue executive orders that have the force of law. We see this as a violation of the separation of powers that potentially allows the Executive to unilaterally “legislate” to the detriment of and without regard to the wishes of the citizenry. Under the Constitution, only Congress may make law, and any Congress that allows these executive orders to go forward unchallenged is unlawfully abdicating their authority, directly in contrast to the important checks and balances put in place by the founders.

Right to Keep and Bear Arms – Second Amendment
We believe that the Second Amendment should be strictly enforced, and that all laws that are in conflict with the Second Amendment should be repealed immediately and all persons held, charged, convicted, and incarcerated under these unjust laws should be freed.

To be punished for injuring or menacing someone is one thing, but to be jailed or incarcerated based on merely owning or possessing the wrong type of firearm promotes a hostility towards gun ownership that erodes this vital guarantee of personal liberty and security.
No longer should any free American citizen be restricted in any way from keeping arms and ammunition of their choosing. We advocate full enforcement of laws that hold violent criminals accountable for their actions.

No federal entity, including FEMA, has the authority to confiscate guns even in a “state of emergency”. In fact, a state of emergency is precisely the time when personal firearms are most important.

Federalism
The United States was conceived as a unified group of independent political “laboratories.” Various states were free to attempt varying and innovative solutions to social and economic problems. This fosters and accelerates growth, and made the Republic one of the most dynamic and competitive political bodies in history. The expansion of federal power has crippled this machine for innovation to the detriment of our great nation.

WAR ON DRUGS
We believe the “War on Drugs” is an unnecessary intervention by the Federal Government, the same as any other ill-conceived and undeclared war. We believe that drug addiction is a medical issue and should be treated as such. Whereas the Constitution delegates to Congress a power to punish treason, counterfeiting, piracies, and offenses against the laws of nations and treaties, we resolve that all Federal laws concerning drugs are void and any regulation or criminal law in regards to drugs are delegated to the several States.

Since the power to regulate, legalize or criminalize drugs falls to the States, the Drug Enforcement Agency of the Federal Government should be disbanded.

The prisons are full of nonviolent people convicted of Federal drug crimes. Nonviolent drug users and sellers should be released and, if needed, obtain treatment for their addictions. "'

I know some among my circle of progressive friends are a little nervous about conservatives wanting to create a "citizen grand jury" for Montana, but I think it's a fantastic idea!
Just imagine! As soon as the law's passed, we can start convening these things to use against the right-wing zealots behind this thing! Duane Sipe, the initiative's sponsor; Richard Stevens of "Freedom Action Rally"; and Sen. Verdell Jackson of Kalispell.

Constitution Party members, Tea Baggers. It wouldn't be hard to drum up some reasons, right? After all, these people believe the income tax is illegal, that most kinds of government activity is illegal, etc & co. I think we can confidently say their tax returns probably could use a good looking-over, right?

But, whoa! I'm getting wa-a-a-a-a-y ahead of myself here. You don't actually need a reason to convene a citizen's grand jury, you just need signatures from half of one percent of a county's registered voters! There'll be time enough after the signatures are gathered to figure out what the grand jury should investigate, because it's the jury that has "sole control" over the "length and depth" of investigations.

And the best thing? You don't even need an indictment to do damage! Isn't that great? Because the proceedings of the grand jury are completely public! That's right! And because of a grand jury's broad powers to call up evidence and testimony (and no sneaky hiding behind the 5th amendment for the accused in a grand jury!), all sorts of irrelevant evidence can be brought up to damage the investigated's reputation. Heck! And you can present all kinds of weak evidence that makes the defendant look guilty in the court of public opinion!

And think about all the costs someone under endless investigation would have to bear! All those trips to Missoula - on work days, of course - toting a lawyer along, the endless depositions, examination of evidence, research, etc & co. Really, if the costs of being investigated by a politically-motivated grand jury doesn't drive these people out of Montana...

And why stop there? How difficult would it be to, say, gather enough signatures to call a citizen's grand jury to look into Dennis Rehberg's role in the Flathead Lake Boat Crash? An afternoon at the Missoula Farmer's Market?

And while we're looking into Rehberg's drinking habits, we can examine his finances, his connections with lobbyists (like Leo Giaocometto!), hell! We can check out his family, make sure they're on the up-and-up, right?

And we can do the same to whoever opts to run against Tester in '12. Or to current legislators. Krayton Kerns! Scott Sales! Just to name a few. And some old names from the past - Marc Racicot! Tim Fox! Judy Martz!

Clever name, isn't it? "Citizens" grand jury? Because, really, it's just a means for a small group of radicals to terrorize their neighbors. Like the "Committee of Public Safety"! Or the local "citizens councils" (or "Soviets" in Russian)! It's a slap to democracy. In fact, all through the report, the brain trust behind these grand juries derides democratic institutions - appointed judges and elected leaders, the entire legal system.

But it's your system. You vote, you have the power to make and change the rules. So, make no mistake, it's not the government these people can't stand, it's you.

The Office of Montana’s Secretary of State Has Accepted a Draft Ballot Initiative Seeking to Provide the Citizens of Montana the Ability to Summon Grand Juries By Petition

Stevensville, Montana, November 10, 2009 – The office of Montana’s Secretary of State (SOS) in Helena has accepted a ballot initiative, to be reviewed by the office of Legislative Services. This is the beginning stage of placing the initiative on the 2010 general election ballot.

This initiative has been labeled ‘Ballot Issue #18’ by the SOS, and is a Constitutional Initiative (CI), seeking to amend Montana’s Constitution, providing for the ability of the citizens to summon Grand Juries by petition.

Currently, the Montana Constitution only provides that a District Judge, at their discretion, may summon a Grand Jury. Article II, Section 20, Paragraph 2 states: “A grand jury shall consist of eleven persons, of whom eight must concur to find an indictment. A grand jury shall be drawn and summoned only at the discretion and order of the district judge.”

Serving as a ‘check and balance’ for the Constitutional Republic known as the United States, the Founders had preserved for the citizens, the right and ability to assure that the public servants kept their activities in line with the intent of the Constitution, and its Bill of Rights, which were ratified on December 15, 1791.

The term Grand Jury is mentioned only in the 5th amendment to the United States Constitution. It is meant to be a right retained by the people. It is a citizen function, not a government function, as the public has been lead to believe.

What do the courts have to say?

“An independent grand jury is to stand between the prosecutor and the accused, and to determine whether a charge is legitimate, or is dictated by malice or personal ill will.”

”Hale v. Henkel, 201 U.S. 43 (1906)

The Supreme Court states that the independent grand jury’s purpose is not only to investigate possible criminal conduct, but to act as a “protector of citizens against arbitrary and oppressive governmental action,” and to perform its functions; the independent grand jury “deliberates in secret and may determine alone the course of its inquiry.”

United States v. Calandra, 414 U.S. 338 (1974)

Article IV, Section 4 of The United States Constitution says: “The United States shall guarantee to every State in this Union a Republican Form of Government …” And, Montana is this form of government. As such, the Montana Constitution states in Section 1: “Popular sovereignty. All political power is vested in and derived from the people. All government of right originates with the people, is founded upon their will only, and is instituted solely for the good of the whole.”

And, in Section 2: “Self-government. The people have the exclusive right of governing themselves as a free, sovereign, and independent state. They may alter or abolish the constitution and form of government whenever they deem it necessary.”

The Founders’ intended for the sovereign citizens to ‘lend’ the public servants their specific duties. Among these is the preservation of constitutionally protected rights. The servants are not in a position, and do not have the ability to take away these sovereign, constitutionally secured rights and powers of the people.

Amending Montana’s Constitution as indicated will serve to restore the Founders’ intent, at the state level, regarding the position of, and political responsibilities required by, the citizenry.

Montana Grand Jury - How do We STOP Corruption in the Montana Judicial System?

When Does Blind Justice in Montana End?

What Can be Done in Montana to STOP the Corruption.. ?what I have been told, shown and heard of over the last 1.5 years and on top of a lifetime in Montana, I see no way to Stop the corruption as the Law is irrelevant, it is based on the opinion of local judges state wide, based on attorneys and their friendships and quickest pay off. Be it Rape, WR Grace Victims, Real Estate Fraud, Robberies, Embezzlement, or other horrible crimes.. well there is only Politics, only Opinion of judges.. and there is no way to STOP corruption among the very legal system itself as the innocent are constantly set up, discredited, and "proved" by illegal and false means to actually be the guilty one.

I see no really way to stop the corruption in the courts and to STOP judges, law officials, Montana County Attorneys, Montana Mayors, Montana Sheriffs .. no way to STOP the local law and government in place that is to uphold the laws.... you simply have to live with it and to pay their wages to Set You Up, Discredit You, Lie To, Keep you in the Dark, Fail to Prosecute real crimes while they set up cops, local citizens, bloggers, law abiding citizens when they try and do the Right Thing and when they point out laws that are being broken and who is breaking them..

There is no way in the State of Montana to Stop these things.. many counties report, un-officially of course of a whole lot of suicides where there is no gun, there is no real evidence as to suicide it is just the official story and a way to kill off the truth.. meanwhile the newspapers fill your head with flat out lies, LIES that 2 years ago I never would have believed existed to the depth that they do. If the paper tells you THE OFFICIAL STORY.. then most of you believe it, expect of course for the ones who were there at the accident, the event.. or whatever the story is about and YOU know the Truth.. but oh well you are a minority on that particular issue so the local paper can keep on lying right..??

No one holds them accountable... Why?

If the Tobacco Valley News had spoken with as many people as we did about the recall they would know that the Tax Paying Citizens of Lincoln County really are scared to Literal DEATH... and they pay for this kind of fear put into them.

If the Tobacco Valley News actually read the plea bargains, talked to victims and got the Real Facts on the Rapes and Reported them to you TRUE and unbiased there would have been dozens less rapes. Do you hold them accountable for the Truth, NO.. most all of you just let bad things happen to good people such as me, you look the other way and assume the paper, the sheriff, the commissioners, the judges are telling you the TRUTH, when in fact they are lying, setting up the innocent and covering up the TRUTH... and while the Innocent Law Abiding People take the fall as they speak up for truth and speak out for a Better County ~ well they get Set Up, Run Out of Town, Threatened Death, Ticketed for Sound Polution - Privacy in Communication Violations and every other tiny thing that can be pushed on them to hide the real CRIMES that they Know of - that they are trying to EXPOSE.

People past, and present in Lincoln County - in Libby, in Troy. they email me, chat me, write me still today.. and they are so afraid of the people in politics, the law, and they are stuck.. they can do nothing but shut up, they can't afford to leave Libby, and the WR Grace issues keep smacking down real estate values, so there is no where to turn, just pay your taxes.

Pay to be treated badly, beaten, set up in courts, proved GUILTY when innocent and pay those in power to Double Tax you and NOT obey the laws you pay them to uphold... you pay them to have sex with your children so they get out of a ticket.. you pay them to set up Truth Seekers like me with Lies, Corruption and False allegation. You give the commissioners raises, or say nothing when they give themselves raises.. in a time when they have lost you jobs, ran the county to the ground.... you are being foreclosed on and you let them give themselve a raise and RAISE your Taxes... you Sit there and you take it... and you believe that Loud Mouths like me just don't have the facts and for some reason just want to stir up trouble and for what.. to make my life better?

Because speaking out for those of you who do not want someone to speak out for well it has cost me everything and now AFTER the recall, well many of you believe the Bogus lies of the Tobacco Valley News as if the Recall was all wrong all along...

well I am here to tell you no matter what happens to me, no matter how much they set me up, lie about me, sick their corrupt judges on me.. the TRUTH will remain the TRUTH and the Recall was the RIGHT thing to do.. the Daughters of the Tobacco Valley are drugged and raped in groups, pictures of under age girls taken right on main street, drugs run rampant, taxes go up.. and YOU let them make me take the fall for it.... Wake UP Eureka... STOP taking IT....

The Tobacco Valley News lies to you about Rapes, Crimes, lies about saying that YOUR not really afraid of DEATH.. and that people just did not want to sign the Recall.. Soooo not true.. those at the Fair certainly know that one.. yet there is NO accountability for the TVN to tell the actual Truth.. many of you say that you do not believe the Tobacco Valley News.. yet then again.. You really do.. because your certainly not buying into the TRUTH..

Just look at the NEW Tax assessment as an example of a powerless community.. the commissioners get a raise, crime goes unprosecuted.. oh unless it is a cuss word to ones own son.. and well those made up crimes that suit the needs of a political cartel...

Stories over and over are surfacing from every corner of Montana, there is no end in site.. WR Grace and the uncovering of lies that the EPA and the State of Montana knew about for decades, nothing you can do but shut up and watch your family suffer and die.. and when money come for those "victims" that Montana law, Montana Courts say cannot be called victims.. well the Political Boys and Gals of Libby Montana soak that money up and our family gets NONE...

So we Must Find a Way to Get the Laws of Montana to be enforced, and to STOP Child Porn, Stop Rape, Stop Corruption.. stop the Innocent from being set up in Corrupt Courts.. and a Montana Grand Jury is One Powerful Way to do such...
